LADY JUSTICIA - A SYMBOLISM OF JUSTICE


Introduction

Lady Justicia, the iconic personification of justice, has played a significant role in our understanding of the principles and ideals underlying the legal system. Her symbolism, with a blindfold, scales, and a sword, represents the concepts of fairness, impartiality, and the power of justice. However, as with any symbolic representation, Lady Justicia has been a subject of both praise and criticism. History of Lady Justicia

Lady Justicia is an allegorical personification of the moral force in judicial system. The history of the iconic symbol of justice was derived from the Greek and Roman goddesses of justice. 

In Greek mythology, the goddesses of justice are Themis (the goddess of justice,order and divine law) and her daughter Dike. In ancient Rome, Justicia was the goddess of justice. Justitia was said to be a virgin living among humans until the wrong doings of mortals forced her to take flight and become the constellation virgo. Justice was one of the virtues celebrated by emperor Augustus in his clipeus virtuis and a temple of Justicia was established in Rome by emperor Tiberius. In the emerging republics, Justicia became a powerful symbol of civil justice.

Lady Justitia is most often depicted in the form of a woman who is standing or sitting. She is typically dressed in toga-like robe, her hair is either flowing over her shoulders or braided around her head. She holds a balance or a set of scales typically suspended from one hand and a sword in the other. Usually, the scales are in the left and the sword in the right. She is also depicted as blind folded. The blindfold only became a fixture around the 16th century. It was typically the roman goodess of justice who was portrayed as blindfolded. The origins of the blindfold are unclear but it might have been added to portray the law as being objective in determining innocence or guilt. 


 Attributes of Lady Justicia

Justice has been personified in the statue of lady Justicia through her attributes of: 

1. Scales

2. Sword

3. Blindfold


  • SCALES: The scales in Justitia’s hand signifies that she balances the act and the consequences of the act to achieve equilibrium and therefore justice. Weighing of arguments and evidence, the strength of the case, supporting and opposing views of the case is the personification of the scales.

  • SWORD: The sword represents authority and conveys the idea that justice can be swift and final. It reminds us that justice has the strength to cut through falsehood, expose the truth and hold accountable those who have violated the law. The sword is the power and authority of the judiciary to enforce the law and protect the society.

  • BLINDFOLD: The blindfold was originally a satirical addition intended to show justice as blind to the injustice carried on before her but it has now been reinterpreted to mean impartiality. The ideal that all individuals regardless of their background, wealth, power or status are treated equally before the law.


Significance of Lady Justicia

1. Fairness and impartiality: Lady justitia is blindfolded, symbolizing impartiality and the notion that justice should be administered without bias or prejudice.


2. Balance and objectivity: it signifies the need to consider all view points and evidence before making a decision, ensuring that justice is based on merits of the case rather than personal opinions.


3. Rule of law: Lady justice holds a sword symbolizing the enforcement of law and authority in the legal system. It represents the power of the court to administer justice and protect the rights and interests of individual within the society. The principles of the rule of law in this context include; 


a. Accountability: The law is made general and everyone is accountable under the law.


b. Just law: The law is just, clear and stable and applies equally to everyone so that no one is above the law.


c. Open Government: The process by which law is adopted and adjudicated is accessible, fair and efficient.


d. Access and impartial justice: Justice is to be delivered timely by competent, neutral and independent representatives.


Lady Justicia embodies the ethical principles that underpin the legal profession . It signifies the value of integrity, honesty and a commitment to upholding the rule of law.


Criticisms and Controversies Surrounding Lady Justicia

The concept and depiction of Lady Justicia have not been immune to criticisms and controversies, particularly regarding biases in the justice system. One prominent criticism is the disconnect between the idealized representation of justice and the imperfect application of justice in reality. While Lady Justicia symbolizes impartiality, fairness, and equal treatment, some argue that these principles are not always upheld in practice. Instances of systemic bias based on race, class, and gender have been highlighted, suggesting a gap between the symbolic representation and the lived experiences within the justice system.
